TERMS & CONDITIONS
The below terms and conditions ("this agreement") explain your (the “Participant”) rights and obligations in connection with use of The Billycan website (the "site") and The Wilderness Field Notes Retreat (the “Retreat”), an event by The Billycan, a subsidiary of ELENA MARC INC (“The Billycan”). All terms of this agreement are legally binding upon any purchase through the site.
PAYMENTS & CANCELLATIONS
1. Terms of service
All amenities, services and activities included in the Retreat are outlined on the booking page. All-inclusive tickets are specific to the Participant's selected accommodations and include access to all weekend workshops, meals (4) and evening drinks. General admission includes Participant's weekend access to Morningside Camps to attend all workshops, meals (4) and evening drinks; accommodations are not included. It is the Participant's responsibility to check the reservation and ensure the particulars contained therein are correct.
Due to the inclusion of alcoholic beverages, Participants must be 21 or older to attend the Retreat.
To reserve a place to participate in the Retreat book a space through the Reserve page and submit the required payment.
4. Cancellation policy
If you wish to cancel your retreat booking you must notify The Billycan via email. Once we’ve received your notice, cancellation will take effect subject to the following: If cancellation takes place more than 30 days prior to the first day of the Retreat, 50% of your face value ticket price will be deducted and the remaining 50% will be refunded, minus transactional fees. If cancellation takes place less than 30 days prior to the first day of the Retreat, you shall not be entitled to any refund of monies advanced and if the face value of the ticket has not been paid in full, you shall still bear the responsibility of such payment.
5. Acknowledgment of Risks
Although The Billycan has taken reasonable steps to ensure safety, I (the Retreat Participant) acknowledge that this Retreat has risks, including certain risks which cannot be eliminated without destroying the unique character of the Retreat. The same elements that contribute to the unique character of the Retreat can cause loss or damage to the Participant including accidental injury, illness or in extreme cases, permanent trauma, disability or death and also can cause damage to or loss of property. The following describes some, but not all, of those risks.
Activities include but are not limited to: hiking, climbing, canoeing, swimming, fishing, foraging, bushwhacking, fire starting, shooting, throwing and chopping. The Billycan reserves the right to alter any workshop activities.
Throughout the Retreat, Participants are responsible for their own safety.
I acknowledge and understand that the Retreat includes risks of injury or death to participants. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified herein and those inherent risks not specifically identified. I acknowledge that participation in this Retreat and all workshops is purely voluntary, no one is forcing participation and participation is elected with full knowledge of the inherent risks.
I assume and accept full responsibility for any injury, death, loss of personal property, and expenses suffered as a result of those inherent risks and dangers identified above, and those inherent risks and dangers not specifically identified and as a result of my negligence in participating in this Retreat.
6. Acknowledgment of Participant Responsibility
I (the Retreat Participant) shall not use the Morningside Camps property except for permitted use and shall not use it for any offensive, noisy, dangerous, illegal, immoral or improper purposes. I shall not do anything that may be a nuisance or annoyance to the Retreat and its guests or staff.
I shall keep all Morningside Camps fixtures, fittings, furniture and effects in a clean and good condition. The Billycan reserves the right to charge for incidentals, including destroyed or missing articles.
7. Release and Waiver of Liability
DECLARATION OF HEALTH. By accepting this Agreement I (the Retreat Participant) represent that I have no physical conditions or medical precautions which would adversely affect my ability to take part in any of the physical activities offered during the Retreat. I fully understand my participation in activities could be injurious to my health and I voluntarily assume all risks related to such activities.
PERSONAL RELEASE. By agreeing to the terms outlined in this agreement I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation in the Retreat, including but not limited to damages as a result of unexpected occurrences including those from weather, wildlife or uncontrollable acts of God, including the risk of death. I release The Billycan, including its owners, directors, employees, guides, instructors and partners, from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage I may incur as a result of participation in the Retreat.
For the benefit of everyone on the Retreat, The Billycan reserves the right at its sole discretion to terminate use of the property or any of its facilities by the Participant in the event of any breach of these terms and conditions. The Participant will be required to vacate the property and The Billycan shall not refund payment or accept any consequential liability damages or loss.
